The Gauci Organic Candles website is provided solely for personal use or as a reference point for trade organisations and businesses wishing to purchase candles. You may not use this website for any commercial purpose or copy or transfer any of the information on the website.

GAUCI ORGANIC CANDLES - TERMS AND CONDITIONS

Free delivery
Free delivery is not automatic and only applies to individual orders totalling £50 or more (excluding delivery charge) to UK standard mainland addresses only, which would normally incur a £5.75 delivery charge. Delivery is handled by a reputable courier. Free delivery is only provided where we have agreed to provide delivery in writing, by email and as part contract agreed in writing.

Where free delivery has not been agreed, a delivery price will be charged based on the weight of the order – for your guidance, please click here for a rough guide to carriage costs. Gauci Organic Candles reserves the right to end, amend, change or extend any free delivery offer at its discretion. If in doubt, please contact us.

1. Online shopping/ordering

1. Online Shopping
1.1 Gauci Organic Candles has taken every care to ensure that the photographs, images, descriptions, colour charts and specification of each of our products is as accurate as possible. However, while the reproduction of colours is a close representation, as the website is viewed on many different computer monitors, with a wide variety of resolutions and settings, we cannot guarantee that the product images you see are an accurate representation of the actual product. It is also important to recognise that our organic candles are hand-made and, because of this, there may be variations in colour, height, width and texture of each candles.  

1.2 By submitting an order to Gauci Organic Candles through this website, you are confirming that you have the authority to use the payment method you have chosen.You also confirm that you have checked your order and that all the details are correct and that you have read, understand and agree to be bound by these Terms and Conditions and, that when your order is accepted and processed by us, payment will be made in full. By placing an order with Gauci Organic Candles you confirm that you are the person referred to in the billing information.

1.3 If you are under the age of 18, you should not register with this website or submit any information to us or attempt to purchase products through this website.

2. Acceptance of your order
2.1 You can order Gauci Organic Candles in two ways; online through this website or by telephone by calling 07866 750848.

2.2 Non-acceptance of your order may be a result of one of the following:

*The candle product you wish to buy is out of stock. Please note, we do carry a range of candles in stock but most of our candle stock is hand-made to order

*We were unable to obtain authorisation for your payment. Please note, we are unable to provide a reason for a payment not being authorised, you would have to contact your bank or facility provider for an explanation.

*We were unable to locate the product type or there is an error in the description.

*Failure to meet the eligibility to order criteria set out in our Terms and Conditions.

2.3 Online
2.3.1 Once you have actioned your order with us by pressing the ‘Pay Gauci’, an email will be sent to you confirming the details of the order. This email is not an order confirmation or order acceptance from Gauci Organic Candles. If you have not received an order acknowledgment within five working days (Monday, Tuesday, Wednesday, Thursday and Friday are working days in relation to these Terms & Conditions), please contact us on 07866 750848 or email us by clicking here stating the date and time of your order.

2.3.2 Acceptance of an order placed by you through the website and the completion of the contract between you and Gauci Organic Candles will take place at the point your order is dispatched.

2.4 Over the Telephone
2.4.1 We will be delighted to help you place an order over the telephone, advise you on the range of merchandise we offer on our website and help you with queries about payment.

2.4.2 We can accept telephone orders Monday to Friday 9.30am to 5.00pm. Our lines are closed on Saturday and Sunday.

2.4.3 When you place an order by telephone you will be given a customer reference number as an acknowledgement of your order. Your order is not accepted at this stage. We accept your order for an item ordered over the telephone at the point at which your order is dispatched.

2.4.4 Gauci Organic Candles reserves the right to record and/or monitor customer telephone calls for security and service monitoring purposes.

2.4.5 Gauci Organic Candles reserves the right to refuse to supply our products to a business or individual without reason or explanation.

3.2 It may not always be possible to stop an order from being dispatched as we do our best to process orders immediately. If your order has already been dispatched, you will need to contact us to arrange returning the goods. Please note that your right to return goods does not apply to certain products. Further details are set out in our Returns Policy in clause 4.

4. Returns Policy
4.1 The Returns Policy is for goods purchased on the website or over the telephone or by post.

4.2 Unwanted goods may be returned for a refund or exchange. Please return them in their original condition, unused (with their original packaging) within 14 days of cancellation.

4.3 Please note that candles cannot be returned if they have been lit.

4.4 Although your statutory rights as a consumer are not affected, the goods are second hand without the packaging and we may not be able to exchange them. You can remove the goods from the packaging to try them out, but don't throw any packaging away.

4.5 When returning goods, we strongly recommend that you use registered post, recorded delivery or another secure method of delivery, retaining the receipt until you have received credit for your return. We regret that we cannot be held responsible for non-delivery of returned goods.

4.6 Please note that the return costs will not be reimbursed. Postage or other return costs will be the customer's responsibility and will be reimbursed by us only in the case of damaged or incorrectly supplied goods.

4.7 Candles must be returned unused and with their original undamaged packaging. We will consider the condition of the goods being returned when making a refund.

4.8 Please return items to us within 14 days of cancellation in order to receive a full refund or exchange. If you notify us of your intention to cancel the contract but do not return the goods to us we reserve the right to deduct the cost incurred by us in recovering the goods, from any refund you are owed.

5. Payment Methods
5.1 We only accept payment for orders in £ sterling.

5.2 We accept payment by PayPal, personal cheque and bacs transfer. For local orders, we also accept COD (cash on delivery).

5.3 Please note, we cannot guarantee the security of data which you send us information by email. Accordingly, please do not send us payment information using email.

5.4 Unless we are fraudulent or negligent we will not be liable to you for any losses caused as a result of unauthorised access to the personal and transactional information you provide us when placing an order.

6. Pricing Policy
6.1 All prices shown on the website are in £ sterling and are inclusive of VAT, where applicable. Prices may change and offers may be withdrawn at any time.

6.2 Although we try to ensure all our prices displayed on our website are accurate, errors may sometimes occur. If we discover an error in the price of an item you have ordered we will contact you as soon as possible. You will have the option to reconfirm your order at the correct price or cancel it. If we are unable to contact you, we may treat your order in respect of the incorrectly priced item as cancelled.

7. Product Availability / Information
As most of our candles and products are hand made to order, we cannot guarantee availabilty. We do have a stock list online but as we sell stock constantly, it is always best to confirm that the candle or item you want is available first.

8. Delivery Information
Please note that the delivery information applies only to orders placed online through gaucicandles.co.uk or telephone orders.

8.1 Mainland UK Delivery. We will confirm any delivery costs at the time of order.

9. The Website
9.1 We may change the Gauci website and correct or update information (including product information) on it or change these terms and conditions at any time without notice.

9.2 This website and its content including all text, graphics, logos, icons, images, data compilations and software used in connection with this website, is our property or that of our suppliers and is protected by copyright law.

9.3 This website may include links to third party web sites. By using these links you agree that we will not be responsible for any loss and do not endorse any product or service.

10. Liability and Indemnity
Gauci Organic Candles and any other products or goods featured on our website or sold by us to you must be used responsibly and carefully. We cannot be held liable for any loss or damage to property or injury to persons howsoever caused. Please read our safety advice carefully before purchasing our products.

11. Privacy and communications
11.1 When you place orders with us online or by telephone, we may collect personal and financial information from you (eg name, address, email address, credit/debit card details). After the sale or transaction has been completed, your details will not be kept on file or stored in any way, either electronically or otherwise. We will never ask you for personal financial information such as PIN numbers or account details.

11.2 To complete our transaction, we may need to email you, telephone you or write to you. By agreeing to these Terms and Conditions, you agree for us to contact you in these ways..

12. Jurisdiction
The website and telephone orders are controlled and managed in the UK. These Terms and Conditions and all matters connected with any order you place on our website or over the telephone are governed by current laws in England and Wales. By ordering from us, you agree to be bound by the law.

13. General
13.1 We may change these Terms and Conditions at any time. If we update our terms in any way, we will note the date of the update and which section it refers to.

13.2 We cannot be held responsible for any delay or failure to comply with our obligations under these Terms and Conditions if the delay or failure is beyond our reasonable control.

13.3 If you breach these Terms and Conditions and we take no action we will still be entitled to use our rights and remedies in other situations where you are in breach.
